These Terms of Service (“Terms”) govern your access to and use of the 7 Day Lap Swimmer program (“Program”), operated by Tarn Media LLC (“Company,” “we,” “us,” or “our”).

By purchasing, accessing, or using the Program, you agree to be bound by these Terms.

Eligibility

You must be at least 18 years old to purchase or use the Program.

License to Use Content

We grant you a limited, non-exclusive, non-transferable license to access and use the Program for personal, non-commercial purposes only.

You may not reproduce, distribute, share, sell, sublicense, or otherwise exploit the Program or any portion of it without prior written permission.

Lifetime Access

Where “lifetime access” is offered, it refers to the lifetime of the Program as offered by the Company, not the lifetime of any individual user.

We reserve the right to modify, suspend, replace, or discontinue the Program (in whole or in part) at any time.

Payments

All prices are listed in U.S. dollars unless otherwise stated.

Access to the Program is granted upon successful payment.

Refund Policy

Refund terms (including any satisfaction guarantee and any pre-sale terms) are described in the “Refund Policy” section below and are incorporated into these Terms.

Disclaimer

The Program is provided for educational purposes only. We make no guarantees regarding specific results.

THE PROGRAM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Termination

We may suspend or terminate your access to the Program (without refund, to the extent permitted by law) if you violate these Terms, including by sharing access, reproducing/distributing content, or using the Program unlawfully.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  1. THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE PROGRAM.

  2. THE COMPANY’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE PROGRAM OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PROGRAM IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU MADE A ONE-TIME PURCHASE, THE AMOUNT YOU PAID FOR THAT PURCHASE).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, liability will be limited to the maximum extent permitted by applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Program or your violation of these Terms.

Assignment

The Company may assign or transfer these Terms, in whole or in part, to an affiliated entity or as part of a corporate restructuring, merger, or sale of assets.

Changes to These Terms

We may update these Terms from time to time.

When we do, we will revise the “Last updated” date at the top of this page. Continued use of the Program after changes become effective constitutes acceptance of the updated Terms.

Governing Law

These Terms shall be governed by the laws of Vermont, USA.

Refund Policy

We offer a 7-day satisfaction guarantee.

If you are not satisfied with the Program, you may request a refund within 7 days of purchase by contacting support@7daylapswimmer.com.

Refunds are not available after this period.

Content Availability & Phased Release

The Program may be released in phases. Some modules, lessons, features, or community components may become available at a later date.

You acknowledge that purchasing the Program does not guarantee immediate access to all content.

Program Availability

The Program may not yet be available at the time of purchase.

Purchasing grants access once the Program launches. Launch dates are estimates and subject to change.

Assumption of Risk – Swimming & Physical Activity

Participation in swimming and water-based exercise involves inherent risks, including but not limited to slips, falls, muscle strain, fatigue, shallow-water blackout, and drowning.

By participating in the Program, you acknowledge and accept these risks.

You agree not to practice breath-holding, prolonged underwater swimming, or hypoxic training alone, and you agree to use appropriate supervision and safety precautions.

No Supervision

The Program does not provide real-time instruction or in-person supervision. You are solely responsible for ensuring your environment, conditions, and supervision are safe.

Stop immediately if you feel dizzy, faint, chest pain, unusual shortness of breath, or any other concerning symptoms, and seek medical attention as appropriate.

Medical Disclaimer

Consult a physician before beginning any exercise program. The Program is not medical advice and does not replace professional supervision.

Release of Liability

To the fullest extent permitted by law, you release and hold harmless Tarn Media LLC from any claims arising from participation in swimming or physical activity in connection with the Program, including claims based on alleged negligence, and including injury or death.
